Namesake Limited operates namesakestore.com, namesakestore.au and namesake.nz. This policy explains what personal information we collect, why we collect it, who we share it with, and what control you have over it.

We handle personal information in accordance with the New Zealand Privacy Act 2020 and its Information Privacy Principles. Where the Australian Privacy Act 1988 applies to our dealings with customers in Australia, we comply with that too.

You can browse our website without telling us who you are. We only start collecting personal information when you buy something, contact us, sign up to our emails, or upload artwork.

This policy forms part of our Terms of Service.

1. What we collect

When you place an order Your name, email address, delivery and billing address, phone number, order details, and the personalisation details you enter, including names, dates, monograms and design selections.

When you upload artwork Photographs, drawings, handwriting or other images you provide for us to turn into an embroidery design.

Where you upload a child's handwriting or artwork, you are providing personal information about that child. By uploading it, you confirm that you are their parent or guardian, or have their guardian's permission.

When you contact us The content of your emails, messages and any attachments you send.

When you sign up to our emails Your email address, and your name and interests if you give them to us.

When you leave a review Your name or display name, your review, and any photographs you upload.

Automatically, when you use our website IP address, device and browser type, operating system, pages viewed, links clicked, search terms used on the site, referring website, and the date and time of your visit. This is collected through cookies and analytics tools. See Section 5.

What we do not collect We do not store your full credit or debit card details. Payments are processed directly by Shopify Payments, Afterpay and our other payment providers. Card details go to them, not to us.

2. Why we collect it

We use your personal information to:

  • make and deliver your order
  • communicate with you about your order, including production updates and dispatch notifications
  • convert uploaded artwork into an embroidery design
  • provide customer support and answer your questions
  • process returns, refunds and warranty claims
  • send you marketing emails, where you have opted in
  • improve our website, products and service
  • run and measure our advertising
  • detect and prevent fraud
  • meet our legal, tax and record-keeping obligations

3. Who we share it with

We do not sell your personal information.

We share it with the service providers who help us run the business, and only to the extent they need it to do their job:

Our digitising contractor receives your artwork and order reference only. They are required to use it solely to produce your embroidery file, not to retain it beyond that purpose, and not to disclose it to anyone else.

We may also disclose personal information where we reasonably believe it is necessary to comply with the law or a legal process, to enforce our terms, to protect intellectual property rights, to protect the security of our website, or to protect people from harm or illegal activity.

If we sell the business. If we propose to sell the business or a material part of it, we may disclose personal information to a prospective buyer so they can evaluate the purchase, and to the buyer on completion so they can continue to operate the business.

4. Information sent overseas

Several of the providers listed above are based outside New Zealand, including in the United States, Canada, Australia and the European Union.

Before sending personal information overseas, we take reasonable steps to satisfy ourselves that the recipient is subject to privacy safeguards comparable to those in the Privacy Act 2020, or we rely on your authorisation, as required by Information Privacy Principle 12.

5. Cookies and tracking

We use cookies and similar technologies to:

  • keep your cart and session working
  • remember your preferences
  • understand how people use the site so we can improve it
  • measure and target our advertising

When you first visit, we ask for your cookie preferences through our consent tool. You can change them at any time. Blocking non-essential cookies will not stop you shopping with us, though some parts of the site may work less smoothly.

You can also control cookies through your browser settings.

6. Marketing emails

We send marketing emails only where you have signed up for them, or where you have bought from us and we are contacting you about similar products.

Every marketing email has an unsubscribe link, and we act on unsubscribes promptly. You can also email us and we will remove you.

Transactional emails about an order you have placed, such as order confirmations, production updates and dispatch notifications, are not marketing and will still be sent while your order is in progress.

7. How long we keep it

  • Order records: seven years, to meet New Zealand tax and business record-keeping requirements.
  • Uploaded artwork and the embroidery files created from it: kept while they may be needed for reorders, warranty claims and our design library.
  • Marketing contact details: kept until you unsubscribe or ask us to delete them.
  • Website analytics data: kept in line with the retention settings of the analytics providers we use.

If you would like your uploaded artwork deleted, email us and we will remove it, subject to any records we are required to keep by law.

8. Keeping your information secure

We use reputable providers, restrict access to personal information to the people who need it, and take reasonable steps to protect against loss, misuse and unauthorised access, modification or disclosure.

No system is completely secure, but if a privacy breach occurs that is likely to cause serious harm, we will notify you and the Office of the Privacy Commissioner as required by the Privacy Act 2020.

9. Your rights

You have the right to:

  • ask for a copy of the personal information we hold about you
  • ask us to correct it if it is wrong or out of date
  • withdraw consent to marketing at any time
  • ask us to delete information we no longer need to hold

Email hello@namesakestore.com and we will respond within 20 working days. We may need to verify your identity before we release information.

10. Complaints

If you are unhappy with how we have handled your personal information, please contact our Privacy Officer first at hello@namesakestore.com. We will take your complaint seriously and work to resolve it.
